We recommend that you carefully read the Terms and Conditions, our Cookie Policy, and our Privacy Policy (hereinafter, collectively, the “Data Protection Policies”) before using this website. By using this website or making a request through it, the User acknowledges being subject to these Terms and Conditions and our Data Protection Policies. If you do not agree to all of the Terms and Conditions and the Data Protection Policies, you should not use this website. These Terms and Conditions may be modified at any time. It is your responsibility to read them periodically, as the terms and conditions in effect at the time of formalization of the respective Contract (as defined below) or use of this website will always be applicable. If you have any questions related to the Terms and Conditions or Data Protection Policies, you can contact us using the contact form. The Contract (as defined below) may be concluded, at your option, in any of the languages ​​in which the Terms and Conditions are available on this website.

II – Our data

The sale of items through this website is carried out under the name Wac Brand by Mundo dos Fatos, Comércio de Vestuário Lda, a company headquartered at Zona Industrial 1, lote 10, 4560-144 Penafiel, registered at the Porto Commercial Registry under number 507 402 022, which is also its corporate tax identification number, with a share capital of 500,000.00 (five hundred thousand euros).

III – Your data and visits to this website

The information and personal data provided by the User will be processed in accordance with the Data Protection Policies. By using this website, the User agrees to the processing of their data and information, and declares that all information and data provided is true and accurate.

IV - Use of our website

By using this website and making requests through it, the User agrees to: Use this website only for making legally valid inquiries and requests. Do not place false or fraudulent orders. If there are reasonable grounds to believe that such an order has been placed, Wac Brand is authorized to cancel it and inform the relevant authorities. Provide accurate and precise information about your postal address, email, and/or other contact details to Wac Brand. The User agrees that Wac Brand may use this information to contact the User, if necessary (see our Privacy Policy).

If you do not provide all the requested information, the User will not be able to place their order. By placing an order through this website, the User declares to be over 18 years of age and to have the legal capacity to enter into contracts.

V - Service availability

The items offered on this website are available for delivery only in the countries available for selection. If you wish, you can order items through this website; however, ordered items can only be delivered to Wac Brand stores designated for this purpose or to delivery addresses in eligible countries.

VI - Formalization of the contract

To place an order, the User must follow the online purchase procedure and select the payment option, before which they must read and accept these Purchase Conditions. At that moment, you will be entering into a purchase and sale agreement with us (the “Agreement”). After doing so, you will receive an email confirming receipt of your order (the “Order Confirmation”). Subsequently, the User will be informed via email confirming shipment of the order (the “Shipping Confirmation”). The invoice with your order details must be attached to the “Shipping Confirmation”.

VII - Product availability

All item orders are subject to availability. The wacbrand.com website uses a real-time stock update system; however, stock errors may occur. Therefore, if there are supply difficulties or items are out of stock, Wac Brand will refund any amounts already paid for the missing items or issue a voucher for the value of those items, within a maximum period of 30 days. Customers can also check the availability of a specific product at a particular store on each product page; however, availability must be confirmed by contacting the store directly, as exceptions may occur.

VIII - Shipping

Notwithstanding clause VII above regarding the availability of items, and except in the case of extraordinary circumstances, Wac Brand will make every effort to ship the order relating to the item(s) described in each Shipping Confirmation before the date indicated in the Shipping Confirmation or, if no delivery date is specified, within the estimated time indicated when selecting the delivery method (store pickup or home delivery) and, in any case, within a maximum period of 30 days from the date of the Order Confirmation. However, delays may occur due to unforeseen circumstances or the delivery area. In the case of the virtual Gift Card, it will be delivered on the date indicated by the User when making their request. If Wac Brand cannot meet the delivery date for reasons beyond its control, the User will be informed of this situation and may choose to proceed with the order, establish a new delivery date, or cancel the order, with a full refund of the amount paid, without prejudice to all other rights to which they are entitled under applicable law. In any case, please note that Wac Brand does not make deliveries on Sundays, except for the virtual Gift Card, which will be delivered on the date specified by the User. For the purposes of these Terms and Conditions, "delivery" shall be understood to have been made or the order "delivered" at the moment the User, or a third party designated by the User, takes physical possession of the items. The virtual Gift Card shall be considered delivered as set forth in the Gift Card Terms of Use and, in any case, at the time of its dispatch to the email address specified by the User.

Delivery times depend on the shipping method selected: 2 business days if you choose courier (Mainland Portugal) and 4 to 7 business days if you choose in-store pickup. Shipping to the islands guarantees delivery within 2 to 4 business days via express airmail. Shipping to the islands means in-store delivery within 10 to 15 business days. International shipping times always depend on the destination.

Please note that these are the delivery times from the moment the order is shipped from our warehouse. The shipping time (departure from our distribution center) is 48 hours for new collection items and 4 to 15 business days for promotional/outlet items. Delivery times may be extended if the item you ordered is out of stock.

IX - Impossibility of delivery

If Wac Brand is unable to deliver an order, we will leave a notification to the User explaining where their order is located and what they need to do to have it delivered to them again. In case of non-delivery of the product due to User default, the corresponding costs for product storage and for new delivery attempts may be charged.

X - Transfer of risk and ownership of the products

The risks to which the items are exposed will be borne by the buyer from the moment of delivery. The User will acquire ownership of the items when Wac Brand has received full payment of all amounts due in relation to them, including shipping costs.

XI - Purchase of products as a guest

The option to purchase items as a guest is also available on our website. When selecting this purchase option, only the essential information to process your order will be requested from the User. Upon completing the purchase process, you will be offered the option to register as a User, or to continue as an unregistered User.

XII - Value Added Tax (ICMS)

All purchases made through this website are subject to the Value Added Tax (VAT) rate in effect in the User's country of delivery.

XIII - Price and payment

This website offers outlet prices year-round. The price of each product will be as stated from time to time on the Wac Brand website, except in cases of obvious errors. While Wac Brand makes every effort to ensure that the prices displayed on the website are correct, errors may occur.

If an error is detected in the price of any of the ordered items, Wac Brand will inform the User as quickly as possible, offering them the option to confirm their order at the correct price, or to cancel it. If it is not possible to contact the buyer, the order will be considered canceled, and Wac Brand will refund any amounts paid by the User. Wac Brand will under no circumstances be obliged to supply the User with any product at an incorrect lower price (even after the Shipping Confirmation has been sent) if the price error is obvious and unambiguous, and can reasonably be recognized by the User as an incorrect price.

The prices shown on the website include VAT, but exclude delivery costs, which will be added to the total price as indicated in our FAQs – Shipping and Delivery. Listed prices may change at any time. However, except in the cases stipulated above, changes will not affect orders for which an Order Confirmation has already been sent. After selecting all the items you wish to purchase, they will be added to your shopping cart, the next step being order processing and payment. To do this, the User must follow the steps of the purchase process, filling in or verifying the information requested at each stage. Furthermore, throughout the purchase process, and before payment, the User can modify the details of their order. Registered users also have a record of all orders placed in the "My Account" section. As a form of payment, the User can use Visa and Mastercard credit or debit cards, Multibanco or MBWay payment reference, as well as PayPal. It is also possible to pay all or part of the purchase amount with a Gift Card, or a Wac Brand voucher issued online.

To minimize the risk of unauthorized access, your credit card data will be encrypted. Once the User's order is received, we will process a pre-authorization on your card to verify the existence of sufficient funds to complete the transaction. The purchase amount will be debited from the User's card when their order leaves the Wac Brand warehouse. In the case of payments via PayPal, the purchase amount will be charged when Wac Brand confirms the order.

By clicking "Authorize Payment," the User confirms that the credit or debit card belongs to them, or that they are the legitimate holder of the Gift Card or shopping voucher. Credit cards are subject to verification and authorization by their issuing bank. If the bank does not authorize the payment, Wac Brand will not be responsible for any delay or failure in delivery, and will be unable to formalize any contract with the User.

XIV - Exchange and Return Policy

Contractual right to return products

The User has a period of 30 days, from the date of order delivery confirmation, to return the items (except for the items mentioned below, for which the right to return products is excluded). The return of the Gift Card will be governed by its Terms of Use. If the User returns the items within the contractual period established by the contractual right of return, but after the regulatory period has expired the brand does not issue a refund, only the amount paid for said items will be refunded. The User will be responsible for the direct costs of returning the product when the return does not occur at a Wac Brand store in Portugal or Spain.

In any case, the User must inform Wac Brand of their intention to return the products using the method available in their personal area of ​​the website and deliver the items to the brand within 14 days from the date of Confirmation of Return Request.

Common provisions

The User will not have a contractual right to return products in relation to underwear and personalized items.

The contractual right to return products applies exclusively to items that are returned in the same condition in which they were delivered. No refund or exchange will be made if the product has been used beyond the opening of its packaging, for items that are not in the condition in which they were delivered, or that have been damaged, and the User must take due care of the item(s) while in possession of them.

The User must return the items using or including all of their original packaging, instructions, and any other accompanying documents. In case of product returns, the items must be returned as follows:

Returns accepted at any Wac Brand store:

The User can return any item to any Wac Brand store. In this case, the User must initiate the return request on the website and then go to the store and present the item(s) to be returned along with the return request submitted on the website. This return method has no associated cost for the User.

Returns (Not in store) by user:

The User must return the product in the same packaging in which it was received and properly sealed so that the items are not damaged during transport. In this return method, the User will bear the associated shipping costs. To the following address indicated:

In all return methods, the return can only be made by requesting it via the “Return/Exchange” option in the order summary in the personal account area of ​​the website.

After examining the item, Wac Brand will inform the User whether or not they are entitled to a refund. Delivery costs will not be refunded, as this is considered a service effectively rendered, even taking into account all its variations.

The refund will be processed as quickly as possible and, in any case, within a maximum of 14 days from the date the User requests the return on the website and intends to return the purchase. Notwithstanding the above, Wac Brand may withhold the refund until it has received the returned items or until the User provides proof of shipment of the items to be returned, whichever occurs first. The refund will always be made through the same payment method used to pay for the purchase, except when this is not possible. In such cases, the User will be asked for an IBAN in their name to make a bank transfer of the amount associated with the return in question.

XV - Defective Products

In cases where the User considers that, at the time of delivery, the product does not conform to what is stipulated in the Contract, they must contact us through our contact form, indicating the details of the order and the product and the damages suffered, or via email at support@wacbrand.com, within the legally established period of two months, so that we can inform them how to proceed.

The User must return the product along with a printed copy of the invoice to the address – Mundo dos Fatos, Zona Industrial 1, lote 10, 4560-144 Penafiel, or to any Wac Brand store, always accompanied by the invoice.

After the product is received at the Wac Brand logistics center, the responsible department will analyze it and provide a response to the User within a maximum of 14 days.

As legally established, instead of canceling the contract (and consequently returning the goods and receiving a refund), you may also choose to replace the product.

The refund or product replacement will be processed as soon as possible and, in any case, within 60 days of the User's request to restore the product to its proper conformity.

The amounts paid for items returned due to damage or defect, when such defects actually exist, will be fully refunded, including the delivery costs related to sending the item to the User.

The refund will be made using the same payment method used for the purchase or, if this is not possible, via bank transfer with a request for IBAN proof.

XVI - Variations that should not be considered defects

The items sold by Wac Brand, especially handcrafted items like footwear, often exhibit characteristics of the natural materials used in their manufacture. These characteristics, such as variations in grain, texture, knots, and color, should not be considered defects or flaws. On the contrary, the User should accept their presence and know how to appreciate them. Wac Brand selects only the highest quality items, but natural characteristics are unavoidable and should be understood as part of the product's individual appearance.

XVII - Intellectual property

The User acknowledges and agrees that all copyright, trademark, and other intellectual property rights in the materials or content provided as part of the website belong at all times to Wac Brand, or to third parties who have granted us a license for their use. The User may use said material only in the manner expressly authorized by us or by those who have granted us a license for its use. This circumstance will not prevent the User from using this website to the extent necessary to copy information about their order or contact details.

XVIII - Right to modify these conditions

Wac Brand reserves the right to modify these Terms and Conditions. We will keep you informed of any substantial changes made to these Terms and Conditions. These changes will not be retroactive and, except in specific cases, will be applied 30 days after the date of their publication in the corresponding notice. If you do not agree with the modifications introduced, we recommend that you do not use our website.

The use of the Wac Brand website and contracts for the purchase of items through it will be governed by Portuguese law.

If the User enters into a Contract as a consumer, nothing in this clause will affect their rights recognized under any applicable legislation in force.

XIX - General Terms and Conditions of the Gift Card

1. This card is valid exclusively for purchasing products on the website.

2. The Gift Card can be purchased using any payment method accepted at www.wacbrand.com. The Gift Card cannot be purchased using another Gift Card.

3. Gift cards are not refundable.

4. The card can only be used once.

5. If the purchase amount exceeds the available balance on the Card, the difference can be paid using any of the other payment methods accepted at www.wacbrand.com.

6. Products purchased with the Card at www.wacbrand.com are subject to the online store's exchange and return policy.

7. The card is valid for a period of 6 (six) months from the date of purchase. Once the term has expired, the Card cannot be renewed, used to purchase items, nor can any unused balance be claimed.

8. The Card is a bearer instrument. Its holder is solely responsible for its use and safekeeping. Wac Brand does not replace the Card in case of theft, loss, misplacement, or damage.

9. If the Card is purchased via www.wacbrand.com, Wac Brand cannot be held responsible for non-receipt or delay in receipt of the Card by its recipient for reasons beyond Wac Brand's control, including, but not limited to, (i) deficiencies or interruption of communication lines, (ii) delay in the transmission of data information or loss of information or data that may occur in the situations foreseen in (i), (iii) inaccuracy of the recipient's data for the Virtual Card provided by the purchaser of that Card, (iv) inability to deliver the Card to the email address provided, or (v) the email forwarded by Wac Brand being considered as spam or unwanted mail.

10.1 Cards originally obtained illegally will be void, cannot be used to purchase goods, and their value will not be refunded.

11.1 The Card may not be used for advertising purposes or to promote products or services marketed by third parties unrelated to the Card issuer, unless prior written authorization is obtained from the issuer.

12. The acquisition and/or use of the Card constitutes knowledge and acceptance of the respective general conditions that were delivered at the time of acquisition of the Card and are available at www.wacbrand.com.
